Terms of Service
Last updated: October 27, 2026
Parties
These terms are a contract between SYRIUS CAPITAL LLC, a limited liability company (LLC) organized under the laws of the State of New Mexico, United States, with tax identification number (EIN) 98-1865579 and registered address at 2105 Vista Oeste NW, Ste E 3166, Albuquerque, NM 87120, United States ("Originl", "we") and the person or company that opens an account ("the Customer", "you"). Originl is a service for professionals: creators, brands, agencies and content teams. If you open the account on behalf of a company, you confirm that you can bind it.
Who can use it
People over 18 (or of the age of majority in their country, if higher) acting for professional purposes. To publish your trial reels from Originl you need a professional Instagram account (business or creator). Originl is not for minors and cannot be used for adult content.
The service
You create one or more profiles (each one is an Instagram account you publish from), upload a video and Originl generates unique variants designed for Instagram to treat as new content. You then schedule them and, once you connect your Instagram account, Originl publishes them on time and measures how they perform at 24 and 72 hours. You can also see the viral videos of the public accounts you follow, for inspiration, and the text that goes with each variant is written by an AI. The platforms where you publish what you create are Instagram, TikTok, YouTube, X, Facebook and Threads. Today Originl posts directly to Instagram, TikTok and YouTube Shorts, depending on your plan; on other platforms you can download the video and post it yourself. Instagram decides how it treats each post: we cannot guarantee reach, views or that a variant is considered new content.
Acceptance
By opening an account and ticking the acceptance box (or by accepting them after signing in with Google) you accept these terms, the Privacy Policy, the Acceptable Use Policy and the Data Processing Agreement (DPA), which form part of them. We store the date and time of that acceptance.
Your account
You are responsible for your account, your credentials and what your team does with the access you give them. You are responsible for having the right to use every video, image, music track, name and link you upload, and for complying with the rules of each platform where you publish (Instagram and Meta, TikTok, YouTube, X, Facebook, Threads).
Your videos and the rights over them
You may only upload videos that are yours or that you are licensed to use and modify. If people appear in them, you need their permission to use their image and voice. It is forbidden to upload other people's content to republish it as your own, sexual or adult content, content involving minors, and content that impersonates a person. You give us the licence needed to host, process and transform your videos for the sole purpose of providing the service. The videos and the variants remain yours. The text the AI writes for your variants is yours to use as you like. Third-party music or clips in your videos must be licensed for the way you use them; when Originl adds music, it uses each platform's audio library, subject to its terms.
Acceptable use
Your use of Originl must comply with the Acceptable Use Policy (/legal/aup). In short: nothing illegal, nothing involving minors, nothing for adults, nothing without the rights, no impersonation, no spam or deception, and no breaking the rules of the platforms where you publish.
Plans, credits and prices
Originl is bought with a monthly or annual subscription. Each plan includes a number of credits per month used to create variants, and you can buy credit top-ups. Current prices are on the pricing page and in the panel. Originl charges no commission on what you earn from your posts: you only pay the subscription and the top-ups. When you start you get 7 days free without leaving a card. Prices, reels and AI seconds for each plan are on the pricing page. A plan's AI seconds renew every cycle and do not roll over; AI seconds you buy as an add-on never expire. Prices exclude taxes: where the law requires it, the applicable taxes for your country are added.
Payments and refunds
Payments are made by card through Stripe: we do not store your card details. The subscription renews itself every month or year until you cancel it. During the 7 free days you are not asked for a card and nothing is charged; when they end, to keep creating variants you have to choose a plan. You can ask for a refund of a subscription payment within 14 days of that payment by writing to soporte@getoriginl.com. If a charge fails, we tell you and retry; if it stays unpaid, variant creation is paused until you sort it out. You can see your invoices and manage your subscription under Settings, in Billing. Add-ons that have already been used (reels or AI seconds) are not refunded.
Intellectual property
Your content remains yours. The platform, its software, design and brand are ours and no right over them is transferred to you beyond using the service.
To improve the service, Originl uses AGGREGATED performance data from all accounts (editing recipes and publishing metrics), so that editing gets better for everyone. Originl NEVER uses one user's content (their videos, variants, texts or specific results) for another user, and never shows it to anyone.
Cancellation and account deletion
You can cancel the renewal whenever you want: you keep the plan until the end of the paid period. You can delete the account from Settings, under Account: the plan does not renew and, after 14 days during which you can undo it, your data is deleted, except invoices, which are kept for as long as tax law requires. Before that you can download a copy of your data. We may suspend or close an account that breaks these terms or puts other customers, third parties or the platform at risk; if minors are involved, the suspension is immediate.
Warranties
We provide the service with care, but we do not guarantee that it will run without interruptions, that Instagram or any other platform will accept or distribute your posts, or that every text written by the AI is accurate or suitable for every case. Platforms change their rules and their repeated-content detectors without telling us. Nothing in this section limits rights that the law does not allow to be limited.
Liability
To the extent permitted by law, we are not liable for indirect damages, lost profits, or the loss of reach, followers or an account due to decisions of the platforms where you publish. In any case, our total liability does not exceed what you paid us in the 12 months before the event that gives rise to it. This cap does not apply to fraud, gross negligence or anything the law does not allow to be limited.
Governing law
These terms are governed by the laws of the State of New Mexico (United States), and any dispute will be settled before the courts of Bernalillo County (New Mexico), with no mandatory arbitration. If you are a consumer living in the European Union, you keep the protection of the mandatory rules of your country and may go to the courts where you live.
Changes
If we make an important change to these terms, we will update the date and notify you in the panel or by email in advance. If you do not agree, you can cancel before they take effect.
